Boat Storage Insurance in Ontario: What Cottagers Need to Know

Two separate policies protect your boat in winter storage -- yours and the facility's. Most cottage owners do not fully understand what each one covers. Here is what to check before you sign an intake form.

The short answer: Your boat insurance almost certainly continues during winter storage, but read the lay-up clause carefully. The storage facility carries its own commercial general liability (CGL) and bailee's coverage, which protects you against damage caused by the facility's negligence. Storm damage, theft, and other non-negligence events fall on your policy. Confirm both before you drop your boat anywhere.

Does my Ontario boat insurance cover winter storage?

Most Ontario boat insurance policies include a lay-up period -- typically October through April -- during which the boat is out of the water and in storage. Coverage usually continues during this period, though some policies reduce premium during lay-up in exchange for slightly narrower coverage terms.

What to check in your policy:

  • Named perils vs. all-risk: Named perils policies only cover what is explicitly listed (fire, theft, collision, etc.). All-risk policies cover everything except what is excluded. All-risk is broader and generally better for storage situations.
  • Lay-up dates: Some policies define the lay-up window precisely. A boat in the water past the lay-up start date or out of storage before the lay-up end date may not be covered by the storage provisions.
  • Off-premises coverage: Confirm the policy covers the boat at a third-party storage facility, not just at your cottage property.
  • Declared value: Policies with an agreed value pay out the stated amount. Actual cash value policies deduct depreciation. In a total loss, the difference is significant.

Action item: Call your marine insurance broker before storage season. Ask specifically: "Is my boat covered during off-premises winter storage at a commercial facility? What perils are covered? Are there any conditions on the storage site?" This call takes five minutes and removes uncertainty.

What insurance does a boat storage facility carry?

A legitimate commercial storage facility carries two types of insurance that matter to you:

1. Commercial General Liability (CGL)

CGL covers third-party bodily injury and property damage arising from the facility's operations. If a visitor is injured on the lot, or if the facility's equipment damages something, CGL responds. For a boat storage operation in Ontario, a minimum of $2 million CGL is standard. Most insurers require $5 million for marine work.

2. Bailee's Coverage (Care, Custody and Control)

This is the policy that matters most for your boat. Bailee's coverage protects property that the facility holds on behalf of its customers. If your boat is damaged through the facility's negligence -- a forklift incident, a fire started by their equipment, a structural failure of their storage system -- bailee's coverage compensates you up to the policy limit.

Important: bailee's coverage is not all-risk coverage for your boat. It responds to the facility's negligence, not to acts of nature or random events. Storm damage, a tree falling on your boat, or vandalism are not the facility's negligence and would not trigger their bailee's policy.

What should I ask a storage facility about their insurance?

Before signing an intake form, ask the facility:

  • What is your CGL coverage amount? (Minimum acceptable: $2M. Preferred: $5M for marine work.)
  • Do you carry bailee's coverage? What is the per-boat limit?
  • Can you provide a certificate of insurance?
  • Is the storage facility fenced and monitored? (Insurance requirements often specify this.)

Any reputable facility will answer all of these without hesitation and provide a certificate on request. Reluctance to share insurance details is a red flag.

Does the storage waiver affect my ability to make an insurance claim?

Storage facilities typically require you to sign an intake agreement that includes a liability waiver. These waivers generally limit the facility's liability for losses not caused by their negligence -- weather events, theft, and similar situations that fall on your own policy anyway.

A well-drafted waiver should not eliminate your ability to claim against the facility's bailee's policy in cases of actual negligence. If a waiver attempts to waive all liability including the facility's own negligence, that is worth flagging with your lawyer before signing. Most standard marina and storage waivers in Ontario follow a reasonable template and do not go that far.

Does shrink wrapping affect my insurance coverage?

Some marine insurers view proper shrink wrapping as a positive factor -- it reduces theft risk, moisture damage, and UV degradation. A few insurers even require appropriate winter covering as a condition of coverage during the lay-up period. Confirm with your broker whether your policy has any covering requirements for outdoor winter storage.
